6:17pm—Due to a legal opinion, AMS President Blake Frederick and VP External Tim Chu will not be recalled from office.
AMS councilors requested a legal opinion from the AMS’ official legal counsel, Davis LLP, regarding whether they can legally recall the executives. Davis has found that a special resolution, or referendum, is necessary in order to recall executives of the AMS, and that the positions of president and VP external are not severable positions.
Davis has advised that two motions may be debated and passed: one to censure the executives, and to require “ratification of certain ‘reputational decisions.’” AMS Council has decided to listen to the legal advice, and the two motions are currently being debated.
